  2. Travelers does not owe you the replacement cost of your vehicle. They do not owe you the cost of a comparable vehicle.

They owe you the fair market value of the actual car that was damaged just before the accident. That means – what you reasonably could have sold that car for given it's age, condition, mileage, options.

They will not pay you 11,000 for a car you only could have sold for 8700.

Although I don't know much about your car – their offer seems to be in line.

  4. This is an not a honest report, the insurance company with the first lady met their obligation by paying the 15000 which is the max bodility injury limit, if they offered that it’s because the at-fault driver had 15/30/5 which means 15000 per driver and 30000 per incident, she should have underinsured or her own medical coverage..allstate met their obligation and should have not been sued it’s the at-fault driver whom should have to paid the the remaining amount.on her bills

  5. There was little damage my car. I was treated for whip lash and finally found out I had three bulging disc in my cervical they paid for. I have a $50,000 uninsured motorist rider on my policy. I at this point was offered $1000 for three discs snapped. Now Travelers are saying they are not paying for degenerative disease. I was never treated for this disease nor knew I had it till this auto whiplash happened. Attorneys will not help not enough money and they don’t want to be tied up for yrs

  7. Corporate Hitlers are evening ripping off serious injuries! Terrorising the injured! Their are not a lot of Plaintiff lawyers who know the laws for the injured, the greedy insurers need to be brought to justice! Insurance Fair Act doctrine is some case law.

  8. I haven’t had insurance for the last three years. No accidents and no chickenshit tickets. I’ve been 22-25 throughout these years. I’ve saved about $4,000 in these years.

  9. If the decking clearly shows the hail damage, they should pay for that as well. If it's rot, they won't.

In either case, DON'T let them throw out the decking – you need to be able to show it to the adjuster.

And you need to call the adjuster in the morning, and ask. Again, it's going to depend on why the decking needs to be replaced.

  13. Nothing set in stone, however, you should get an advance within a week or so, and usually the claim is settled within 4-6 weeks.

As long as the fire isn't suspicious in nature, then usually the biggest holdup is 1. getting a copy of the fire report from the fire department and 2. getting the list of personal property damaged from the insured.

If you are having problems or questions with your claim, you should talk to your agent. Travelers is pretty good about claims, and the agents should really be holding your hand through this time.

  14. Correct devilcajun, they never mentioned that she could have used her MP cov if she carried it. Also the bills are her responsibility until she wants to settle the claim or within the statute for that state. I wonder if the 15k offer was the BI policy max, and if so she would need to try and file a Underinsured Motorist claim with her own insurance company once settled.

  15. He files a claim with the insurance for the car that caused the accident.

If the Corolla was stopped behind him and hit him because the Allstate car hit it and pushed it into him….then he files against the Allstate car. The Corolla's insurance will deny him.

Or….the easy way….file under his own collision coverage (if he has it). His company will pay for the damage to his car less his deductible and then pursue the at fault company for re-payment. Once they recover, they will forward his deductible onto him.

  16. Well, there are "Standards of Fault" from case law, that are used to determine fault. And if the other guy was going straight through the intersection, and you were turning . . .. you should have yielded to the oncoming vehicle – legal turn or not – which DOES make you mostly at fault for the accident. It's actually kinda generous of them to declare their guy 20% at fault – they didn't HAVE to do that.

Now, this is lesson learned for next time, of course, but when you don't have collision, even if you think the other guy is at fault, have your car towed to YOUR HOUSE. That way there aren't any storage fees – just the towing bill.

NONE of this is Travelers fault. THEY didn't hit you. The other driver did – when you turned in front of them. You're right – it took WAY too long for them to look at your car, BUT, you're not their policyholder! THey have NO obligation to you, until a judge says their guy is at fault and has to pay!

Now, I know you're not going to pick me for best answer, because you're not going to like these things. But next time, if you want YOUR insurance company to help you work a claim, you'll have to buy the collision coverage. And before you turn left into an oncoming vehicle, be certain they aren't close enough to hit you, even if they floor the gas. Because now YOUR liability will likely be paying 80% of THEIR damages, and 80% of THEIR medical/bodily injury.

Actually, if you REALLY think they're 100% at fault, just call your agent, and ask them to call your adjuster (because you KNOW they're going to go after you for the 80% of damage to their car), and ask if your insurance company agrees with their determination of fault. See how much your liability ends up paying out – and ask them for the percentage.
